In accordance with Federal law"On the contract system in the field of procurement of goods, works, services to meet state and municipal needs" Government Russian Federation decides:

1. Establish that:
procurement by customers light goods industries originating from foreign countries(except for member states of the Eurasian Economic Union), and (or) services for the rental of such goods (hereinafter referred to as goods, services) to meet federal needs not related to the state defense order, according to the list in accordance with Appendix No. 1, goods and ( or) services to meet the needs of the constituent entities of the Russian Federation and municipal needs according to Appendix No. 2, it is not allowed, except in cases where there is no production of goods in the territories of the member states of the Eurasian Economic Union;
an additional requirement for participants in the procurement of goods and (or) services to meet federal needs, including within the framework of the state defense order provided for in Appendix No. 1 to this resolution, goods and (or) services to meet the needs of the constituent entities of the Russian Federation and municipal needs provided for Appendix No. 2 to this resolution is the use in the production of goods and (or) provision of services of materials or semi-finished products, the country of origin of which is a member state of the Eurasian Economic Union (hereinafter referred to as materials or semi-finished products). This additional requirement does not apply if there is no production of goods, materials or semi-finished products on the territories of the member states of the Eurasian Economic Union;
confirmation of the absence of production of goods, materials or semi-finished products on the territory of the Russian Federation is carried out by the authorized body of the Russian Federation in the manner established by it.

2. In the case of purchasing goods and (or) services from sole supplier When describing the characteristics of goods and (or) services in the notice of purchase from a single supplier, customers establish a condition on the use of materials or semi-finished products in the production of goods. This condition does not apply if there is no production of goods, materials or semi-finished products in the territories of the member states of the Eurasian Economic Union.

3. Authorized body The Ministry of Industry and Trade of the Russian Federation is responsible for confirming the absence of production of goods on the territory of the Russian Federation.

4. To the Ministry of Industry and Trade of the Russian Federation:
develop and approve, before September 1, 2014, rules for issuing a conclusion on the absence of production of goods on the territory of the Russian Federation;
conduct consultations with interested executive authorities of the member states of the Eurasian Economic Union on the issue of determining a mechanism for confirming the absence of production of goods, materials or semi-finished products in the territories of these states.

5. To recognize as invalid:
Decree of the Government of the Russian Federation dated March 30, 2012 No. 269 “On the establishment additional requirements to order placing participants when placing orders for supplies individual species goods for needs federal bodies executive power" (Collected Legislation of the Russian Federation, 2012, No. 15, Art. 1786);

6. This resolution comes into force on September 1, 2014, with the exception of paragraph 4 of this resolution, which comes into force from the date of signing of this resolution.

State and municipal procurement. The government supports domestic manufacturers, including in the light industry. Therefore, Government Resolution 791 of 08/11/2014 was adopted. It should be noted that it is impossible to purchase not only products of foreign origin, but also rental services.

Resolution 791 came into force on September 1, 2014. From that moment on, the ban itself began to apply, and indication of it in the notice and documentation of the auction became mandatory.

What regulates

791 Decree of the Government of the Russian Federation establishes two different requirements for the purchase of light industry products:

  • ban on the admission of foreign light industry products;
  • establishing additional requirements for bidders.

Let's take a closer look at the prohibitions defined in light industry (LPROM) by Resolution 791. The ban on the admission of goods of foreign origin must be observed by customers federal significance(for example, the Federal State Institution “St. Petersburg Specialized Psychiatric Hospital with Intensive Observation” or the Federal Public Institution “Roads of Russia”). This category of customers also includes:

Among the goods that are subject to the ban established for organizations and authorities at the federal level are leather clothing, carpets and rugs, textile fabrics, shoes ( full list products can be seen in Appendix No. 1).

As for customers of regional and municipal significance, then there is also a ban for them to purchase light industry products, namely, bed and table linen, rental services for textiles, clothing and shoes ( full list can be seen if you refer to Appendix No. 2).

If we turn to additional requirements, then 791 Decree of the Government of the Russian Federation with latest changes contains an indication that customers must include a requirement for tender participants to use materials in the production of goods whose country of origin is Russia, Belarus, Kazakhstan, Armenia or Kyrgyzstan (EAEU countries). But this condition does not apply if there is no production on the territory of the designated countries.

How is Government Resolution 791 on establishing a ban applied?

The purchase of goods of foreign origin is possible if there is no such production in the territory EAEU countries.

It should be noted that the absence of the Ministry of Industry and Trade of Russia is confirmed when issuing a conclusion. It is issued to the customer who applied for issuance; this must be done before posting a notice of bidding. The application must be accompanied by information about the technical and operational characteristics of the product. The Ministry of Industry and Trade reviews the information and makes a decision on issuance or refusal. The latter means that the products are manufactured in the above countries and the customer does not have the right to purchase foreign goods.

If the purchased products are on the specified list, the customer is obliged to reflect this in the bidding documentation.

Moreover, if during the tender process an application is received indicating a product not produced in the territory of the EAEU countries, then the application is subject to rejection under Resolution 791.

The Government of the Russian Federation decides:

Approve the attached changes that are being made to the Decree of the Government of the Russian Federation of August 11, 2014 N 791 “On establishing a ban on the admission of light industry goods originating from foreign countries for the purpose of procurement to meet federal needs” (Collection of Legislation of the Russian Federation, 2014 , N 34, art. 4660).

CHANGES,

WHICH ARE INTRODUCED TO THE DECISION OF THE RUSSIAN GOVERNMENT

1. The title should be stated as follows:

"On establishing a ban on the admission of light industrial goods originating from foreign countries and (or) rental services for such goods for the purpose of procurement to meet federal needs, the needs of constituent entities of the Russian Federation and municipal needs."

2. Paragraphs two and three of paragraph 1 should be stated as follows:

"purchase by customers of light industrial goods originating from foreign countries (except for member states of the Eurasian Economic Union), and (or) rental services for such goods (hereinafter referred to as goods, services) to meet federal needs not related to the state defense ordering, according to the list in accordance with Appendix No. 1, goods and (or) services to meet the needs of the constituent entities of the Russian Federation and municipal needs in accordance with Appendix No. 2 is not allowed, except in cases where there is no production of goods in the territories of the member states of the Eurasian Economic Union;

an additional requirement for participants in the procurement of goods and (or) services to meet federal needs, including within the framework of the state defense order provided for in Appendix No. 1 to this resolution, goods and (or) services to meet the needs of the constituent entities of the Russian Federation and municipal needs provided for Appendix No. 2 to this resolution is the use in the production of goods and (or) provision of services of materials or semi-finished products, the country of origin of which is a member state of the Eurasian Economic Union (hereinafter referred to as materials or semi-finished products). This additional requirement does not apply if there is no production of goods, materials or semi-finished products on the territories of the member states of the Eurasian Economic Union;".

3. Clause 2 should be stated as follows:

"2. In the case of purchasing goods and (or) services from a single supplier, customers, when describing in the notice of purchase from a single supplier the characteristics of goods and (or) services, establish a condition on the use of materials or semi-finished products in the production of goods. This condition does not apply in “if there is no production of goods, materials or semi-finished products on the territories of the member states of the Eurasian Economic Union.”

4. In paragraph three of paragraph 4, replace the words “Republic of Belarus and the Republic of Kazakhstan” with the words “member states of the Eurasian Economic Union”.

The Kolarctic cross-border cooperation program, the implementation procedure of which is provided for by the Agreement on the financing and implementation of the Kolarctic cross-border cooperation program for the period 2014 - 2020, signed in Moscow on December 29, 2016;

Cross-border cooperation program "Russia - South-East Finland", the implementation procedure of which is provided for in the Agreement on the financing and implementation of the cross-border cooperation program "Russia - South-East Finland" for the period 2014 - 2020, signed in Moscow on December 29, 2016;
