Buying an apartment is a responsible step in which it is necessary to check the legal purity of the apartment. Especially close attention should be given to apartments with a “privatization” history. That is, these are apartments that were previously privatized from the state and then put up for sale. One of the risks may be the non-participation of minor children in privatization back in the 90s.

But in the original version of this law there was no talk about the rights of minor children. Art. 2 laws allowed citizens to register ownership with consent adults family members. If a dispute arises over the legality of privatization, this agreement, as well as the certificate of ownership, may be declared invalid by the court on the grounds established civil law(Resolution of the Plenum of the Supreme Court of the Russian Federation dated August 24, 1993 No. 8).

Invalid transactions are divided into voidable (invalid due to its recognition by the court) and void (regardless of such recognition).

For void transactions, the statute of limitations is three years. Moreover, as stated in the Civil Code of the Russian Federation, the limitation period begins from the day when the execution of this transaction began.

Let us remind you that previously the statute of limitations for void transactions was not 3 years, but 10 years! But in 2005, changes were made to the Civil Code of the Russian Federation, as a result of which the period was reduced to 3 years.

Let’s say the parents privatized the apartment in 1993, and the child was 6 years old at that time. But the child could not defend his rights at such a young age. But he can sue, having reached the age of majority, and demand, in legal language, “to apply the consequences of the invalidity of a void transaction.” He has 3 years for this. That is, until the age of 21, such a person has the right to count on judicial protection of his violated rights.

Although in judicial practice there are cases when the judge recognized that it was his responsibility to protect the rights of the child. legal representatives, and the statute of limitations in the above situation has expired for the child.

But even if the statute of limitations has expired, this does not mean that the person has lost the right to go to court . As stated in Civil Code RF, a claim for the protection of a violated right is accepted for consideration by the court regardless of the expiration of the statute of limitations. And no matter how many years have passed since privatization or since coming of age, a citizen has the right to file a claim in court.

But if the defendant compares the dates and finds out that the plaintiff missed the statute of limitations, then he has the right to demand that the judge reject the claim, since the corresponding period has been missed. The limitation period is applied by the court only upon the application of a party to the dispute, and in this case a decision is made to dismiss the claim. If neither the defendant nor the plaintiff declared the application of the limitation period, the case will be considered on its merits.

What advice can you give to a prospective plaintiff who has not met the statute of limitations?

First of all, don't despair. In some cases, if the court finds that the limitation period has been missed due to good reason, then the violated right of a citizen is subject to protection. So you need to prove in court that you had such reasons.

The plaintiff, for example, may claim that he was a minor and could not independently defend his rights in court.

Another argument of the plaintiff will be the absence of a document from the guardianship and trusteeship authority - permission not to include the child among the owners of the apartment.

You should also be aware of the following. According to the law, privatization without including minors falls under worthless deal , for which the limitation period begins to run from the moment the transaction is executed. But in court you can bring a claim for recognition of the transaction partially invalid , for example, in terms of not including a minor among the owners. In this case, the limitation period will be calculated from the day when the person learned or should have learned about the violation of his right. That is, 1 year from the day the citizen learned of a violation of his rights. And then you need to prove that you recently learned about the violation of your rights.

What can be advised to those who privatized housing in violation of the rights of minors, but want to “correct”?

A citizen whose rights have been violated has the right to file a lawsuit and invalidate the privatization. Then the apartment can be privatized again, but with all citizens included in the number of owners. Only citizens living in a residential building, that is, officially registered in it, can privatize housing.

You can demand in court to recognize the privatization deal as partially invalid, and then include the former minor among the owners.

A person whose right to privatization was violated as a minor may go to court at any time. Until recently, such transactions were in most cases considered by the courts as partially void. The limitation period was first 10 years, and then 3 years, which were calculated from the moment of execution of the transfer agreement.

However, as follows from the Review of Legislation and Judicial Practice Supreme Court Russian Federation for the third quarter of 2008, the statute of limitations in in this case must be calculated in accordance with paragraph 2 of Art. 181 of the Civil Code of the Russian Federation and clause 1 of Art. 200 Civil Code of the Russian Federation. This means that the agreement for the transfer of residential premises in the manner of privatization, in which the number of owners was not included minor child, is partially not insignificant, but partially voidable transaction, the statute of limitations for which is only one year, but is calculated not from the moment of execution of the transfer agreement, but from the day when the person learned or should have learned about the violation of his right to privatization.

Therefore, it is necessary to purchase residential premises, during the privatization of which the rights of minors were violated, with extreme caution. If their rights were not restored by the guardianship and trusteeship authorities while still a minor during the alienation of residential premises, It’s better to refuse such a deal altogether .

United arbitrage practice on the application of limitation periods has not been fully formed. Some courts determine the beginning of the limitation period by the date of the transaction, incl. privatization, however, such a position is hardly applicable when a claim is brought by a prosecutor.

According to clause 2. Article 45 of the Code of Civil Procedure of the Russian Federation, the prosecutor who filed the application uses all procedural rights and bears almost all the procedural responsibilities of the plaintiff. This means that the limitation period for filing claims in the interests of citizens who are unable to independently defend their rights is legitimate interests when concluding contracts regarding real estate and determining the moment of violation of these rights, must be calculated from the moment when the prosecutor became aware of a violation of the rights of such citizens . That is, the statute of limitations is not considered missed. The Moscow City Court took a similar position when considering the relevant cassation submissions prosecutors.

But this opinion is not the only one in this matter! Opponents of this approach argue that prosecutors cannot influence the statute of limitations. Then there is another way. For a citizen who could not protect his rights for reasons related to his personality (and the reasons for the inability of a minor to independently submit an appropriate application are often related to this), the statute of limitations can be restored (Article 205 of the Civil Code of the Russian Federation).

Courts also restore the statute of limitations when considering cases involving claims of guardians and trustees. Without denying the fact that the limitation period has expired (thereby indirectly confirming the start of the period from the moment the transaction was completed), the courts, in most cases, restore the missed period, recognizing the reasons for missing it as valid.

When completing a transaction with privatized apartment, in which minor children live (or do not live, but at the time of privatization had equal rights to this apartment with the owners), the lawyers of our company check whether they were registered in this or another apartment. If the minor children of the owner or any person registered in this apartment are not registered anywhere, then you cannot buy such an apartment - this will be a violation of the rights of minor children. Therefore, the problem of cyclicality has always attracted the attention of economists and today remains one of the central problems of economic theory.

    Reasons for the cyclical nature of the economy and types of economic cycles.

Economic development is not carried out linearly along the path of recovery, but undulating. This is expressed in a certain pattern of alternating periods of production growth with periods of sharp economic decline (recession), and then periods of sluggish economic conditions, recovery and recovery. Such alternations of periods of economic development are called economic cycle.

Economic schools explain the reasons for cyclical development in different ways. The English economist D. Robertson counted more than 200 different points of view on the causes and essence of the cyclical nature of economic development. Among these points of view one can name “monetary theories”, which explain the cause of cyclicality and crises by disorders in the sphere of credit and money circulation; “psychological” theories, according to which these reasons lie in the loss of confidence among businessmen in the stability of their economic situation, in major miscalculations in the conduct of business; “investment” theory of the cycle, which considers fluctuations in the size of capital investments as the cause of cyclicality and crises. Marxist theory proceeds from the fact that the main cause of economic crises of overproduction is the main contradiction of capitalism: the contradiction between the social nature of production and the private, capitalist form of appropriation of the results of labor, and all other reasons are derivative, secondary.

Currently, two theories of the cyclical development of a crisis economy are most widely used: the “theory of underconsumption” and the “theory of disproportionality.”

    Underconsumption of the population due to rising prices, a decrease in its effective demand generates an unsold mass of goods. It increases as production activities continue and demand for products lags. As a result, there is an overproduction of goods, which causes an economic crisis. These are the concepts of D. Keynes, arguing that stimulating aggregate demand and consumption can serve as a means of combating crises.

    Disproportionality in the development of industries and regions causes cyclical development and can cause an economic crisis. Crises inherent in the market system, which is characterized spontaneity of development, complex interweaving of connections between the spheres of economics, production and financial activities, trade, unbalanced money circulation, etc. Crisis phenomena primarily arise in industries producing durable goods. This is caused, firstly, by rising prices for these goods; secondly, the growth of income, a significant part of which is used as savings. At the same time, the share of consumption stabilizes, and savings in the form of investments go to expand production, which causes overaccumulation. As a result, a disproportion between production and consumption arises, which develops into a crisis. Production begins to decline, incomes fall, firms go bankrupt, and only the renewal of fixed capital creates material opportunity to overcome the crisis.

Using the achievements of scientific and technical progress reduces the costs of production, makes it competitive, and makes production profitable; the crisis gives way to depression.

In this way, spreading from industry to industry, it begins revival . The development of production absorbs all new investments, incomes grow, demand and consumption grow, the revival turns into

The economic balance of a market economy is achieved through the wave-like development of reproduction and sales processes. Each cyclical wave represents an economic cycle (or business cycle), which includes four phases: crisis, depression, recovery, recovery (Fig. 4).

The first cyclical economic crisis of overproduction broke out in England in 1825, the second in 1840 in Germany. Since then, they have been repeated periodically (every 8-12 years). different countries. Since 1837, crises have become global.

Cycles are never the same: they differ in the duration of the phases, the depth of the decline, the level of rise and other specific manifestations. But the crisis, being an inevitable phase of the cycle, is usually perceived as a surprise, since it comes after the recovery phase.

The most destructive was the world crisis of 1929-1933. World industrial production fell by 44% during this crisis. The economy was set back 20 years. The depression lasted until 1935, and after a recovery in 1937, the crisis broke again, interrupted by World War II. In the United States, this crisis was called the “Great Depression.”

Among the post-war crises, the following stand out:

    the crisis of 1957-58, when the depth of the decline in industrial production was 15%;

    crisis of 1974-75, which was complicated by structural crises - energy, currency. A fall industrial production amounted to 11.6%;

    crisis of 1980-82, during which the fall in industrial production amounted to 8.4%, although there was a transition of the capitalist economy to an energy- and metal-saving type of economic growth.

In addition to those discussed above cyclical economic crises of overproduction, covering almost all spheres of reproduction and marking its new equilibrium with more efficient production on a qualitatively new basis, there are others types of crises. Among them are the following: mid-term crisis, which usually does not cover all areas of the economy, is local, less deep in nature than cyclical, and can temporarily arise even during a phase of recovery and recovery; partial crisis, covering any one area or branch of the economy (for example, credit, budget, monetary, etc.); structural crisis, covering a number of economic cycles and industries that require a transition to new equipment and technology. This includes energy, raw materials, food and other crises.

Depression (stagnation, stagnation) is quite long (from 6 months to 3 years). This is a period of adaptation to new economic conditions, when uncertainty and lack of coordination of actions reign in society. The economic downturn has stopped, but growth trends have not yet emerged. Production is sluggish, at minimal levels, but inventories are already beginning to dissolve. The entrepreneur does not risk investing capital, although prices have stabilized and bank interest rates have fallen to their lowest level. However, the way out of the crisis begins precisely in the depression phase. By selling goods at very low prices, you can nevertheless earn income if the cost of these goods is less than their price. To do this, renovation and re-equipment of production with new equipment and technology begins, which reduce production costs and reduce the cost of products. This creates the material basis for reviving production and overcoming the crisis.

Revival characterized by the restoration of business activity, growth of investment, and employment. The revival primarily affects industries producing means of production. New enterprises are emerging and old ones are being modernized. An increase in employment causes an increase in wages. After the pre-crisis level of development is reached, a recovery begins, which ensures economic growth.

Rise (or expansion) characterized by an increase in all economic indicators: prices, production volumes, employment, profits, wages, money turnover etc. New technologies and equipment are being introduced into production, new industries are emerging that create new products. An increase in capital investment is accompanied by an increase in stock prices and interest rates. The rise reaches a maximum, which is called prosperity or boom. When this phase ends, all economic indicators begin to decline, and a new crisis begins.

All cycles in reality are not similar to each other; each has its own specific features and interweavings. Moreover, each crisis arises as if unexpectedly and is caused by some completely exceptional circumstances. In the period between crises, as in the sea in clear weather, disturbances and “shocks” in the form of partial, small and intermediate recessions are possible, which gave reason to talk about different types economic crises.

Development cycles of social production differ by type, depending on their duration. There are short-term, medium-term and long-term economic cycles.

Short-term economic cycles represent fluctuations in market conditions under the influence of changes in supply and demand, competition and prices. These cycles are usually observed in agriculture, the service sector (tourism, hotel business, etc.)

Medium-term economic cycles determined by the period of reproduction and renewal of fixed capital, the beginning and end of the cycle (the period from crisis to crisis).

Long-term economic cycles , expressing long-term trends in economic development, include downward and upward phases. The problems of large cycles make it possible to discover new opportunities in the mechanism of economic growth.

Economic cycles are usually given the names of scientists who have devoted special research to this problem and are called waves. The most famous cycles are N.D. Kondratiev (50-60 years old), called “long waves”, S. Kuznets cycles (18-25 years old), i.e. “medium waves”, cycles of K. Juglar (10 years) and short cycles of J. Kitchen (2 years and 4 months).

Short-term cycles It is customary to call cycles by Kitchin, who devoted his work to this problem in 1923. Kitchin associated the duration of the cycle, which he assumed to be three years and four months, with fluctuations in world gold reserves. However, at present, such an explanation of the causes of the short-term cycle can satisfy very few.

Most modern economists who support the idea of ​​the existence of short-term economic cycles tend to consider them only as an integral part of the general cyclical system, the basis of which is medium-term economic cycles, called Juglar cycles, named after the French economist who studied economic fluctuations in the second half of the 19th century.

Can such things be called mere coincidences? Of course you can. But upon closer examination, such cases may also turn out to be manifestations of the miraculous. They can be dismissed as random phenomena in a world of chaos. But it is also possible to recognize them as potentially fateful events, which they may well turn out to be.

I don't believe in meaningless coincidences. I believe that coincidences are messages, clues that you should pay close attention to.

By paying due attention to coincidences and their meaning, you maintain a connection with a deeper layer of infinite possibilities. This is where the magic begins. I call this state Synchro-Fate - it allows you to fulfill any desire. Synchro-destiny involves accessing the deepest levels of your being; In addition, you must pay close attention to the intricate dance of coincidences in the material world. One must try to penetrate into the nature of things, to realize the existence of a source of intelligence, thanks to which the creation of the Universe continues to this day. A person must strive to realize the opportunities that open to him and thereby change his life.

The more attentive you are to coincidences, the more often they happen and the wider your access to clue messages. If you learn to listen to the world of the soul, much will become possible. The worst destroyer is stress. If you are tense, if you feel hostility towards someone or something, your inner balance is disturbed. Wherever you go, at a deep level you always carry information about the true essence of your “I”.

Try to imagine that the Universe is a huge single organism. If we lived in tune with the soul level, we would see that the best, brightest part of our “I” is in tune with the rhythms of the Universe. Your mind would interpret the situation very differently than mine. At the sight of a dog, I would let the lei run away. You would call the dog by whistling and play with him.

Interpretation occurs at the level of the mind, but the movements of the individual soul are determined by accumulated experience; With the help of memories of the past, the soul predetermines our choice and perception of certain situations. The tiny grains of events that fall into memory throughout life, as well as the combination of memory and imagination fueled by experience, are called karma. Karma accumulates in the individual “part” of the soul, in the core of our essence - and determines the properties of our “I”. It is this personal component that controls consciousness and makes us who we are. However, our actions can affect this “individual soul” and change karma - for the better or for the worse.

The universal, non-local component of the soul is not subject to actions, but it is connected with the spirit - pure and unchanging. Enlightenment can be defined as “the awareness of oneself as an infinite being observing and being observed from some localized point of view.” And no matter how mediocre our life today may be, it is never too late to “connect” to that part of the soul that is called limitless, undiluted potential, and change our existence. On the other side of the curtain, on the other side of space and time, the soul is hidden - alive, energetic, immortal. If you live according to the laws of the true world, you can consciously change your own destiny. Changes will occur due to the synchronization of non-causal (at first glance) relationships: this is how you shape your destiny - the term “synchronized destiny” comes from here. The category of Synchro-Fate presupposes conscious participation in shaping one's own life - for such participation it is necessary to understand the world, inaccessible to sensory perception. Consciousness directly depends on attention and intention. Whatever is in the center of your attention seems to be charged with energy. Grounds for the emergence of property rights to land ownership

The grounds on which the formation of proprietary rights to land ownership is possible:

  1. Gratuitous use, also known as “urgent”. Formed in the event of a similar transaction, or the presence of a corresponding act.
