Benefit amounts

The amounts accrued to working women directly depend on wages, however, there are maximum and minimum limits for payments:

• the maximum amount of benefits for uncomplicated pregnancy is 248,164 rubles (since the beginning of 2016);
• the minimum amount is 34521.20 rubles (since July 2016).

The maternity allowance is calculated based on the average daily earnings for the previous two years, in 2016 it will be 2014 and 2015. It is multiplied by the number of days according to the disability certificate. The amount is transferred in one lump sum in full.

If a pregnant woman continues to work after receiving a sick leave, her vacation time and the amount of payment for it are reduced, since the law prohibits receiving a salary and benefits at the same time. In this case, the money will be transferred after the actual vacation.

The law allows applying for the payment of benefits for pregnancy and childbirth within six months after the birth of a child, but if there are good reasons (illness, relocation, disaster) you can apply to the FSS later than this period.

How to calculate the amount yourself?

The simplified formula for calculating the amount of "maternity leave" is simple: multiply the average daily earnings (the amount of income for the previous two calendar years / the number of calendar days) by the number of vacation days according to sick leave (140, 156, 194).

However, when calculating on your own, you need to keep in mind some nuances:

1. The maximum average daily earnings are limited by the maximum base for calculating contributions to the FSS, the amount is regularly indexed and in 2016 amounted to 1,772.6 rubles. 4. From the number of calendar days taken into account for calculating the average daily earnings, the periods spent on sick leave, the time spent in maternity leave, days when a woman was released from work, received a salary, but insurance premiums were not included in it.
5. With work experience up to six months, the amount is calculated based on the minimum wage.

Lump sum payments

Under federal law, there are two guaranteed one-time payments:

• for pregnant women registered up to 12 weeks;
• for women who have successfully delivered a child.

In the first case, funds are transferred as part of compulsory social insurance (for working women or those who were reduced due to the liquidation of the company and registered with the employment service during the year) or in the form social security(for female students, graduate students, contract servicemen). The most secure in terms of social guarantees pregnant women are employed, but the unemployed are also entitled to payments. Their amounts and the calculation procedure depend on the category of unemployed women.

This Law defines the main areas of activity of the state authorities of the Khanty-Mansiysk Autonomous Okrug - Yugra (hereinafter also - autonomous region) in the field of family support, motherhood, paternity and childhood, within the powers granted by law, determines additional measures, measures of social support in this area.

Article 1

The main activities of the state authorities of the Khanty-Mansiysk Autonomous Okrug - Yugra in the field of social support within the powers granted by law are:

increasing the birth rate, raising the status of the family;

Article 2. Types of allowances and payments to citizens with children

1. This Law establishes on the territory of the Autonomous Okrug the following types allowances and payments to citizens with children:

1) a one-time allowance for the birth of a second child;

2) a one-time allowance for the simultaneous birth of two or more children;

3) monthly allowance for the care of a child from one and a half to three years and from three to four years;

4) monthly allowance for a child (children);

1.1. The measures of social support established by this Law are provided to citizens taking into account the following criteria of need:

1) the presence of a low average per capita income - for social support measures established by subparagraphs 4, 11, 13 - 15 of paragraph 1 of this article;

2) lack of employment due to the need to care for a young child - for the measure of social support established by subparagraph 3 of paragraph 1 of this article;

3) the predominance of minor dependents in the family - for social support measures established by subparagraphs 9, 13 and 15 of paragraph 1 of this article and article 3 of this Law;

2. Benefits and payments specified in paragraph 1 of this article, with the exception of benefits specified in subparagraphs 4 - 6, 9, 12 of paragraph 1 of this article, are established by one of the parents (legal representatives) who is a citizen of the Russian Federation permanently residing in the territory Khanty-Mansiysk Autonomous Okrug - Yugra for at least ten years, for a child (children) living (living) together with him and are of a declarative nature.

The calculation of the ten-year period is carried out taking into account all periods of residence of a citizen on the territory of the Khanty-Mansiysk Autonomous Okrug - Yugra, regardless of the timing and reasons for interrupting residence.

The allowance specified in subparagraph 4 of paragraph 1 of this article is established by one of the parents (legal representatives) for the child (children) living (living) together with him and is of a declarative nature.

The benefit specified in subparagraph 5 of paragraph 1 of this article is established to the recipient of the survivor's pension and is of a declarative nature.

The allowance specified in subparagraph 6 of paragraph 1 of this article is established by one of the parents (legal representatives), who is a citizen of the Russian Federation, for the child (children) living (living) together with him and is of a declarative nature.

The allowance specified in subparagraph 9 of paragraph 1 of this article, as well as the measures of social support provided for in paragraph 2 of Article 3, are established for one of the parents (legal representatives) who is a citizen of the Russian Federation permanently residing on the territory of the Khanty-Mansiysk Autonomous Okrug - Yugra, on children living with them and is of a declarative nature.

The allowance specified in subparagraph 12 of paragraph 1 of this article is established by one of the parents, who is a citizen of the Russian Federation, permanently residing on the territory of the Khanty-Mansiysk Autonomous Okrug - Yugra, for a child (children) living (living) together with him and is of a declarative nature.

The payment of benefits specified in subparagraphs 9 and 13 of paragraph 1 of this article is also carried out in the event that the child (children) lives separately from their parents (legal representatives) in another locality at the place of education in a professional educational organization, an educational organization of higher education.

If the right to receive a lump-sum allowance arises on several grounds specified in subparagraphs 1, 2, 7 and 10 of paragraph 1 of this article, the lump-sum allowance is paid on one of the grounds at the choice of the applicant. The right to choose and receive benefits is given to one of the parents.

If the right to receive a lump-sum allowance arises on several grounds specified in subparagraphs 11 and 13 of paragraph 1 of this article, the lump-sum allowance is paid on one of the grounds at the choice of the applicant. The right to choose and receive benefits is granted to one of the parents (legal representatives).

The procedure for assigning and paying benefits, as well as monthly cash payments, is established by the Government of the Khanty-Mansiysk Autonomous Okrug - Yugra.

Accounting for information about citizens receiving benefits, payments and other measures of social support specified in paragraph 1 of this article, subparagraph 1 of paragraph 2 of article 3, articles 3.1 and 4.1 of this Law is carried out in the regional register of recipients of social support measures.

Article 2.1. One-time allowance for the birth of a second child

A one-time allowance for the birth of a second child is established in the amount of 10,000 rubles, subject to registration of the birth of a child in government bodies records of acts of civil status on the territory of the Khanty-Mansiysk Autonomous Okrug - Yugra.

Article 2.2. One-time allowance for the simultaneous birth of two or more children

A one-time allowance for the simultaneous birth of two or more children is established for one of the parents for newborn children living with him in the amount of 15,000 rubles for each child, subject to registration of the birth of children in state civil registry offices on the territory of the Khanty-Mansiysk Autonomous Okrug - Yugra.

Article 2.3. Monthly allowance for caring for a child from one and a half to three years and from three to four years

1. The monthly allowance for caring for a child from one and a half to three years and from three to four years is established:

1) to a parent (legal representative) actually caring for a child subject to compulsory social insurance in case of temporary disability and in connection with maternity, who is on leave to care for a child until the child, in respect of which the right to the appointment of a monthly allowance has arisen, reaches the age three years;

2) to the parent (legal representative) actually caring for the child undergoing military service under a contract serving as a member of the rank and file and commanding staff of the internal affairs bodies, the State fire service, an employee of institutions and bodies of the penitentiary system, bodies for controlling the turnover drugs and psychotropic substances, customs authorities and who is on parental leave until the child, in respect of whom the right to a monthly allowance has arisen, reaches the age of three years;

2. A monthly allowance for caring for a child from one and a half to three years is paid in the amount of 5,000 rubles, regardless of the number of children being cared for.

3. A monthly allowance for caring for a child from three to four years old is paid in the amount of 2,500 rubles, regardless of the number of children being cared for.

4. A monthly allowance for caring for a child from one and a half to three years and from three to four years is established for the persons specified in paragraph 1 of this article, subject to the following conditions:

1) insecurity of the child with a place in a state or municipal educational organization implementing the main general educational program of preschool education;

2) the absence of the fact of refusal of the parent (legal representative) from the place allocated to the child in the state or municipal educational organization implementing the main educational program of preschool education.

The number of places not provided with places in state or municipal educational organizations that implement the main general educational program of preschool education includes children who are on the waiting list for preschool education in these educational organizations at the place of residence.

5. A monthly allowance for caring for a child from one and a half to three years and from three to four years is provided to families whose average per capita income does not exceed the subsistence level in the Khanty-Mansiysk Autonomous Okrug - Yugra.

Article 2.4. Monthly allowance for a child (children)

1. A monthly allowance for a child (children) is established for citizens of the Russian Federation, foreign citizens and stateless persons, including refugees, residing on the territory of the Khanty-Mansiysk Autonomous Okrug - Yugra, whose average per capita income does not exceed the subsistence level in the Khanty-Mansiysk Autonomous Okrug - Yugra, in the amount of 300 rubles for each born, adopted, adopted under guardianship (guardianship) of a child until he reaches the age of 16 years (for a student of a general education organization - until he graduates, but not more than until he reaches the age of 18 years).

Article 2.5. Monthly social allowance for children who have lost their breadwinner

The monthly social allowance for children who have lost their breadwinner is set to the recipient of the survivor's pension in the amount of 1,000 rubles, provided that the survivor's pension is received on the territory of the Autonomous Okrug in accordance with the legislation of the Russian Federation.

Article 2.6. Monthly social allowance for disabled children

Monthly social allowance for disabled children is set to a parent (legal representative) in the amount of 1,000 rubles for each disabled child, provided that a social pension is received on the territory of the Autonomous Okrug in accordance with the legislation of the Russian Federation.

Article 2.7. One-time allowance for the birth of the third and subsequent children

1. Families with many children are provided with a monthly allowance in the amount of 300 rubles for each child born, adopted, taken under guardianship (guardianship) until they reach the age of 18 years.

1. A one-time allowance upon admission of a child (children) to the first grade of a general educational organization is established by one of the parents (legal representatives).

3. Article 2.12. One-time allowance for the birth of a child (children) by persons from among the indigenous peoples of the North

For persons from among the indigenous peoples of the North, who have the status of a subject of the right of traditional nature management, upon the birth of one or more children and subject to the cohabitation of newborn children with their parents, one of the parents is entitled to a one-time allowance in the amount of 20,000 rubles for each child born.

Article 2.14. Social support for students in state general education organizations, municipal general education organizations, private general education organizations that carry out educational activities for state-accredited basic general education programs, state professional educational organizations and private professional educational organizations

1. Article 2.15. Monthly cash payment to families in the event of the birth of a third child or subsequent children

1. Monthly cash payment in the event of the birth of a third child or subsequent children after December 31, 2012 and registration of the birth of the child in the civil registry offices on the territory of the Autonomous Okrug is established for families from among citizens permanently residing in the Khanty-Mansiysk Autonomous Okrug - Yugra and having average per capita income not exceeding the average subsistence level per capita established by the Government of the Khanty-Mansiysk Autonomous Okrug - Yugra.

2. The right to receive the monthly cash payment specified in subparagraph 14 of paragraph 1 of Article 2 of this Law is used by the family once.

3. Families entitled to receive monthly benefits and monthly cash payments specified in subparagraphs 3, 4 and 14 of paragraph 1 of Article 2 of this Law, for a child, in connection with the birth of which the right to a monthly cash payment arose, specified in subparagraph 14 of paragraph 1 article 2 of this Law, benefits or payments are provided at the choice of the applicant.

4. The monthly cash payment specified in subparagraph 14 of paragraph 1 of Article 2 of this Law is provided regardless of the number of children in the family under the age of three years in the amount of the subsistence minimum for children established in accordance with Article 5 of the Law of the Khanty-Mansiysk Autonomous Okrug - Yugra "On the consumer basket and the procedure for establishing the subsistence minimum in the Khanty-Mansiysk Autonomous Okrug - Ugra", for the period until the child reaches the age of three years.

5. When establishing the right of citizens to a monthly cash payment specified in subparagraph 14 of paragraph 1 of Article 2 of this Law, in determining the sequence of birth of children, children in respect of which these citizens were limited in parental rights (deprived of parental rights), children, in respect of which the adoption was canceled, and children under guardianship and guardianship.

Article 2.16. One time cash payment

1. A one-time cash payment may be provided to citizens from among the recipients of benefits or payments specified in subparagraphs 1-14 of paragraph 1 of Article 2 of this Law.

2. The procedure, conditions for granting and the amount of a one-time cash payment are established by the Government of the Khanty-Mansiysk Autonomous Okrug - Yugra.

Article 3. Measures of social support for large families

1. Families with many children on the territory of the Khanty-Mansiysk Autonomous Okrug - Ugra are recognized as families raising three or more children under the age of 18, including those under guardianship (guardianship), living together with parents (parent), other legal representatives from among citizens of the Russian Federation permanently residing in the Khanty-Mansiysk Autonomous Okrug - Yugra, included in the regional register of recipients of social support measures.

2. The following measures of social support are established for large families specified in paragraph 1 of this article:

1) compensation in the amount of 50 percent of the costs of paying utility bills (cold and hot water supply, sewerage, electricity, gas supply (including supplies of domestic gas in bottles), heating (heat supply, including supplies of solid fuel in residential premises with stove heating )).

Measures of social support for payment of utility services, established by this Law, are carried out on the basis of the standards for the consumption of utility services, tariffs for payment of utility services established in accordance with applicable law.

Compensation for utility bills is provided for no more than one dwelling (residential building, part of a residential building, apartment, part of an apartment, room), except for cases of possession, use and disposal large family two living quarters;

3. The basis for the provision of social support measures to large families of the Autonomous Okrug is a certificate of a large family of the Khanty-Mansiysk Autonomous Okrug - Ugra.

Article 3.1. A measure of social support for paying utility bills to citizens awarded the Order of Parental Glory, the medal of the Order of Parental Glory

1. Citizens awarded the Order of Parental Glory, the medal of the Order of Parental Glory are provided with compensation in the amount of 50 percent of the costs of paying for utilities (cold and hot water supply, sewerage, electricity, gas supply (including household gas supplies in cylinders) , heating (heat supply, including the supply of solid fuel to residential premises with stove heating) at the permanent place of residence in the Khanty-Mansiysk Autonomous Okrug - Yugra.

if a child under the age of 18 is declared fully capable in accordance with the legislation of the Russian Federation.

Article 4. Family health care

1. To each family member for medical reasons under the Program state guarantees providing citizens with free medical care on the territory of the Khanty-Mansiysk Autonomous Okrug - Yugra are provided free consultations on family planning, the presence of socially significant diseases and diseases that pose a danger to others, on the medical and psychological aspects of family and marriage relations, as well as medical genetic, other consultations and examinations in healthcare organizations in order to prevent possible hereditary diseases in offspring.

2. Executive bodies The state authorities of the Autonomous Okrug, with the participation of the mass media, actively promote a healthy lifestyle, family traditions that ensure the harmonious development of the individual.

3. Nursing mothers who are members of families with an average per capita income, the size of which does not exceed the subsistence level in the Khanty-Mansiysk Autonomous Okrug - Yugra, are provided with medicines, medical products and specialized medical food products in accordance with the list established by the Government of Khanty- Mansi Autonomous Okrug - Ugra.

4. Children of the first and second year of life; children aged two to three years who are brought up in families with an average per capita income that does not exceed the subsistence level in the Khanty-Mansiysk Autonomous Okrug - Ugra are provided with free dairy products.

5. Children under the age of three are provided free of charge with medicines, medical supplies and specialized medical nutrition products in accordance with the list established by the Government of the Khanty-Mansiysk Autonomous Okrug - Yugra.

6. The procedure for providing medicines, medical products, specialized health food products and dairy products is established by the Government of the Autonomous Okrug.

Article 4.1. Lump-sum allowance to spouses in connection with the anniversary of their life together

1. A one-time allowance to spouses in connection with the anniversary of their life together is established for one of the spouses who is a citizen of the Russian Federation, permanently residing in the Khanty-Mansiysk Autonomous Okrug - Yugra, subject to at least 15 years of work experience in the Autonomous Okrug, depending on the anniversary living together in the following dimensions:

1) 50 years - 50,000 rubles;

2) 55 years - 55,000 rubles;

3) 60 years - 60,000 rubles;

2. The procedure for assigning and paying a one-time allowance to spouses in connection with the anniversary of their life together is established by the Government of the Khanty-Mansiysk Autonomous Okrug - Yugra.

Article 5. Support in the field of education, culture, physical culture and sports, tourism

Management bodies of education, culture and art, physical culture and sports, tourism of the Khanty-Mansiysk Autonomous Okrug - Yugra:

provide support to the winners of competitions - institutions of education, culture, physical culture and sports, tourism, working with families and children;

carry out scholarship, bonus and other forms of support for gifted children in the field of education, culture, physical culture and sports.

Article 5.1. Granting families with many children the right to free visits to cultural institutions, sports facilities of physical culture and sports institutions of the Autonomous Okrug

1. Families with many children specified in paragraph 1 of Article 3 of this Law, once a month, are granted the right to visit free of charge:

1) museums, parks of culture and recreation, as well as exhibitions held by cultural institutions of the Autonomous Okrug;

2) sports facilities of institutions of physical culture and sports of the Autonomous Okrug, including those for physical culture and sports.

2. Order of free visit large families institutions of culture, sports facilities of institutions of physical culture and sports of the Autonomous Okrug is established by the Government of the Autonomous Okrug.

Article 6. Financing of measures of social support

1. The source of financing of social support measures in the field of family support, motherhood, fatherhood and childhood in the Khanty-Mansiysk Autonomous Okrug - Yugra is the budget of the Autonomous Okrug.

Financing of social support measures in the form of compensation, benefits, payments is carried out taking into account the costs of directly providing compensation, benefits, payments and the costs associated with their provision. Limits of expenses related to the provision of social support measures in the form of compensation, allowances, payments are established by the Government of the Autonomous Okrug.

Delivery of compensations, allowances, payments to citizens residing on the territory of the Autonomous Okrug, at the choice of a citizen, is carried out in the form of postal or bank transfers.

2. The Government of the Autonomous Okrug, when drawing up the budget of the Autonomous Okrug for the next financial year, provides necessary funds for the implementation of this Law.

Article 7. Entry into force of this Law

This Law shall enter into force upon the expiration of ten days from the date of its official publication.

The monthly cash payment specified in subparagraph 14 of paragraph 1 of Article 2 of this Law shall be made until January 1, 2018.

Article 8. Bringing regulatory legal acts in line with this Law

Propose to the Governor of the Khanty-Mansiysk Autonomous Okrug - Yugra, the Government of the Khanty-Mansiysk Autonomous Okrug - Yugra, within three months from the date of entry into force of this Law, to bring regulatory legal acts in line with this Law.
