Financial assistance to families with children

The city budget also provides about 30 types of one-time and regular cash payments in the form of benefits, compensation (in connection with pregnancy and childbirth, at the birth of a child, large families, and others).

Support for large families

Who has the right to receive state benefits in connection with the birth and upbringing of children?

The following have the right to receive state benefits in connection with the birth and upbringing of children:

ABOUT SOCIAL SUPPORT FOR FAMILIES WITH CHILDREN IN MOSCOW

This Law, in order to implement targeted social policy aimed at creating conditions for improving the standard of living of families with children, regulates relations in providing them with cash payments and other measures of social support.

Chapter 1. GENERAL PROVISIONS

Article 1. Scope of this Law

1. This Law applies to citizens of the Russian Federation, foreign citizens and stateless persons residing in the city of Moscow.

2. The place of residence of citizens of the Russian Federation, foreign citizens and stateless persons is established according to the data of the registration authorities.

Article 2. Basic concepts

1. A large family is a family in which three or more children were born and (or) are being raised (including adopted children, as well as stepchildren and stepchildren) until the youngest of them reaches the age of 16 years, and those studying in an educational institution that implements general education programs, - 18 years. Article 3. Social support measures for families with children

Social support measures for families with children include:

1) one-time, monthly and annual cash payments;

2) providing in-kind assistance;

3) provision of benefits;

4) organization of social services.

Article 4. The right of children left without parental care to cash payments

Children left without parental care have the right to cash payments in accordance with Moscow City Law No. 61 of November 30, 2005 “On additional guarantees for social support for orphans and children left without parental care in the city of Moscow.”

Chapter 2. CASH PAYMENTS

Article 5. The body responsible for the appointment and payment of monetary payments

6. In the event of a stillbirth, a one-time compensation payment for reimbursement of expenses in connection with the birth (adoption) of a child and a one-time compensation payment for reimbursement of expenses in connection with the birth (adoption) of three or more children at the same time are not assigned or paid.

7. One of the parents (adoptive parent, guardian) of the child has the right to a one-time compensation payment to reimburse expenses in connection with the birth (adoption) of three or more children at the same time.

8. Receiving one-time cash payments of one type does not deprive a family of the right to receive other types of one-time cash payments.

9. One-time cash payments are established regardless of the average per capita family income.

10. An additional one-time benefit in connection with the birth of a child is assigned to young families in accordance with the Moscow City Law of September 30, 2009 N 39 “On Youth”.

Article 7. Monthly cash payments

1. Monthly cash payments include:

1) monthly child benefit;

2) monthly compensation payment for children under the age of one and a half years;

3) monthly compensation payment to a person caring for a disabled child or a person disabled since childhood up to the age of 23;

4) monthly compensation payment to reimburse expenses in connection with the rising cost of living for certain categories of families with children;

5) monthly compensation payment to reimburse expenses due to the rising cost of living for families with three or more children;

6) monthly compensation payment to compensate for the increase in the cost of food for certain categories of citizens for children under three years of age;

7) monthly compensation payment for the purchase of children's goods for families with five or more children;

8) monthly compensation payment to families with 10 or more children;

9) monthly compensation payment to mothers who gave birth to 10 or more children and receive a pension;

10) regional social supplement to the pension of a disabled child;

11) regional social supplement to the pension of a child receiving a pension due to the death of one or both parents;

12) monthly compensation payment to reimburse expenses for housing and utilities for families with three or more children;

13) monthly compensation payment for using the telephone to families with three or more children;

14) monthly compensation payment to reimburse the costs of paying for residential premises and utilities and for using a telephone in the residential premises in which the minor under guardianship (trusteeship) actually lives;

15) monthly compensation payment to disabled children who have lost their breadwinner and disabled persons from childhood up to the age of 23;

16) monthly compensation payment for a child under 18 years of age living in a family in which both or the only parent do not work and are disabled people of group I or II.

2. If there is a right to monthly cash payments specified in paragraphs 10 and 11 of part 1 of this article, one of them is assigned.

3. The monthly cash payments specified in paragraphs 2-16 of part 1 of this article are assigned regardless of the average per capita family income.

4. Monthly child benefit is assigned in accordance with the Moscow City Law “On monthly child benefit”.

Article 8. Monthly compensation payment for children under the age of one and a half years

A monthly compensation payment for children under the age of one and a half years is established for a mother dismissed due to the liquidation of an organization or the termination of activities by an employer - an individual during pregnancy, maternity leave, leave to care for a child under the age of one and a half years.

Article 9. Monthly compensation payment to a person caring for a disabled child or a person disabled since childhood up to the age of 23

1. A monthly compensation payment is established for one of the parents (guardian, trustee) who is not employed in accordance with the Law of the Russian Federation of April 19, 1991 N 1032-I “On Employment of the Population in the Russian Federation” and who is caring for a disabled child or a disabled person with childhood up to the age of 23 years.

2. The monthly compensation payment is established for the following categories of working citizens caring for a disabled child or a disabled person from childhood up to the age of 23:

1) single mother (father);

2) widow (widower);

3) a parent who divorced the father (mother) of the child;

4) the parent whose child’s paternity has been established;

5) one of the parents with many children;

6) a guardian (trustee) of a disabled child or a person disabled since childhood under the age of 23, left without the care of a parent from among the persons specified in paragraphs 1-5 of this part.

3. A monthly compensation payment is established for one of the foster parents and foster carers (with the exception of short-term foster care) involved in caring for a disabled child.

Article 10. Monthly compensation payment to reimburse expenses in connection with the increase in the cost of living for certain categories of families with children

1. A monthly compensation payment to reimburse expenses in connection with the increase in the cost of living for certain categories of families with children is established for children:

1) single mothers (fathers);

4) under the age of one and a half years, whose parents are disabled and (or) pensioners.

2. Categories of single mothers (fathers), families of military personnel undergoing military service on conscription, and families in which one of the parents evades paying alimony are determined in accordance with the legal acts of the city of Moscow regulating the procedure for assignment and payment monthly allowance per child.

3. For each child under the age of 16 (studying in an educational institution implementing general education programs - 18 years old) and classified in one or more categories specified in part 1 of this article, one monthly compensation payment is established to reimburse expenses in connection with with the rising cost of living.

4. The right to a monthly compensation payment to reimburse expenses in connection with the increase in the cost of living has one of the parents (adoptive parent, guardian, trustee) for each child born (adopted, taken under guardianship (trusteeship) and child living with him, as well as a stepfather or stepmother - for children from large families.

Article 11. Monthly compensation payment to reimburse expenses in connection with the rising cost of living for families with three or more children

A monthly compensation payment to reimburse expenses due to the increase in the cost of living for families with three or more children is established for one of the parents (adoptive parent, guardian, trustee, stepfather, stepmother) for each child until he reaches the age of 18 years.

Article 12. Monthly compensation payment to compensate for the increase in the cost of food products for certain categories of citizens for children under three years of age

1. A monthly compensation payment to compensate for the increase in the cost of food products for certain categories of citizens for children under three years of age is established for children:

1) single mothers (fathers);

2) military personnel undergoing military service upon conscription;

3) from families in which one of the parents evades paying child support;

4) from large families;

5) from student families;

6) who are disabled.

2. For each child under three years of age classified in one or more categories specified in Part 1 of this article, one monthly compensation payment may be established to compensate for the increase in the cost of food for certain categories of citizens for children under three years of age.

Article 13. Monthly compensation payment for the purchase of children's goods for families with five or more children

1. A monthly compensation payment for the purchase of children's goods is established for families:

1) having five or more children under the age of 18;

2) having 10 or more children, if there are one or more children in the family under the age of 18.

Article 14. Monthly compensation payment to families with 10 or more children

1. A monthly compensation payment for families with 10 or more children is established for each child under the age of 18 (full-time students in an educational institution implementing general education programs, an institution of primary, secondary and higher vocational education - up to 23 years).

2. One of the parents (adoptive parent, guardian, trustee, stepfather, stepmother) has the right to a monthly compensation payment.

Article 15. Monthly compensation payment to mothers who gave birth to 10 or more children and receive a pension

A monthly compensation payment is established for the pension of mothers who have given birth to 10 or more children, regardless of the type of pension received.

Article 16. Regional social supplement to the pension of a disabled child

A regional social supplement to the pension of a disabled child is assigned in the manner established by the Moscow Government.

Article 17. Regional social supplement to the pension of a child receiving a pension due to the death of one or both parents

A regional social supplement to the pension of a child receiving a pension due to the death of one or both parents is assigned in the manner established by the Moscow Government.

Article 17.1. Monthly compensation payment to reimburse expenses for housing and utilities for families with three or more children

1. A monthly compensation payment to reimburse the costs of paying for living quarters and utilities for families with three or more children is established for one of the parents (guardian, trustee, stepfather, stepmother) regardless of whether this family receives social support measures for paying for living quarters and utilities and number of residential premises.

2. A monthly compensation payment to reimburse expenses for housing and utilities for families with three or more children is established until youngest child age 18 years.

Article 17.2. Monthly compensation payment for telephone use for families with three or more children

A monthly compensation payment for telephone use for families with three or more children is established for one of the parents (guardian, trustee, stepfather, stepmother) until the youngest child reaches the age of 18.

Article 17.3. Monthly compensation payment to reimburse expenses for living quarters and utilities and for using a telephone in the residential premises in which a minor under guardianship (trusteeship) actually lives.

A monthly compensation payment for reimbursement of expenses for payment for living quarters and utilities and for the use of a telephone in the residential premises in which a minor under guardianship (trusteeship) actually lives is established for the guardian (trustee) regardless of receipt Money for the maintenance of a child under guardianship (trusteeship) and a monthly child benefit.

Article 17.4. Monthly compensation payment to disabled children and people with disabilities from childhood up to the age of 23 who have lost their breadwinner

Article 17.5. Monthly compensation payment for a child under 18 years of age living in a family in which both or the only parent do not work and are disabled people of group I or II

A monthly compensation payment is established for each child under the age of 18 living in a family in which both or the only parent do not work and are disabled people of group I or II. A single mother (father) is considered the only parent.

Article 18. Annual compensation payments

1. Annual compensation payments include:

1) annual compensation payment for International Family Day;

2) annual compensation payment for Knowledge Day.

2. The annual compensation payments specified in Part 1 of this article are established regardless of the average per capita family income and are paid to families with 10 or more children, if there are one or more children in the family under the age of 18.

Article 19. Annual compensation payment for the purchase of a set of children's clothing for attending classes during the period of study

An annual compensation payment for the purchase of a set of children's clothing for attending classes for the period of study is established for children from large families for the period of study in educational institutions that implement general education programs.

Article 20. Amounts of monetary payments, the procedure for their assignment and payment

The amounts of monetary payments, the procedure for their assignment and payment are established by the Moscow Government.

Article 21. Grounds for refusal to assign monetary payments, suspension and termination of payments

1. The grounds for refusal to assign one-time cash payments are:

1) the child is fully supported by the state;

2) deprivation of citizens of parental rights or restriction of their parental rights.

2. The grounds for refusal to assign monthly cash payments are the circumstances specified in part 1 of this article, as well as the marriage of a disabled child or a person disabled since childhood (for the monthly compensation payment specified in paragraph 3 of part 1 of article 7 of this Law), receipt, in accordance with the procedure established by the legislation of the city of Moscow, by the guardian (trustee) of funds for the maintenance of a child under guardianship (trusteeship), with the exception of a monthly compensation payment for reimbursement of expenses for payment for living quarters and utilities and for the use of a telephone in the residential premises in which actually lives a minor under guardianship (trusteeship), and a monthly compensation payment to a person caring for a disabled child or a person disabled since childhood up to the age of 23 years.

3. Payment of monthly cash payments is suspended in the cases specified in parts 1 and 2 of this article, as well as in the following cases:

1) failure to receive monthly cash payments for six consecutive months;

2) the court recognizes the child as missing;

3) announcement minor child fully capable in accordance with federal legislation or acquiring full legal capacity from the time of marriage;

4) marriage of a disabled person since childhood who has reached the age of 18 years (for the monthly compensation payment specified in paragraph 3 of part 1 of Article 7 of this Law).

3.1. If the monthly compensation payment specified in paragraph 3 of part 1 of article 7 of this Law is suspended in accordance with paragraphs 3 and 4 of part 3 of this article, then its payment is resumed to the disabled child himself or to a disabled person since childhood in the absence of other grounds for its suspension or termination .

4. Payment of monthly cash payments is terminated in the following cases:

1) the child in respect of whom the application for a monthly cash payment has reached the age upon which the payment of the monthly cash payment ceases in accordance with this Law;

2) removal of the recipient of the monthly cash payment or the child for whom it is assigned from registration in the city of Moscow;

3) the death of a child or the court declaring him dead;

4) placement of the parent (parents) at work (for monthly compensation payments specified in paragraphs 3 and 16 of part 1 of Article 7 of this Law).

5. Annual cash payments are not assigned if, upon the occurrence of the circumstances specified in parts 1 and 2, paragraph 2 of part 3 and part 4 of this article, the condition established by part 2 of Article 18 of this Law on the number and age of children in the family is not met.

6. The provisions of this article do not apply to monthly compensation payments to reimburse expenses in connection with the increase in the cost of living for disabled children receiving a pension, and for children receiving a pension due to the death of one or both parents, provided for in Articles 16, 17 of this Law , which are assigned and paid in the manner established by the Moscow Government, and also do not apply to the annual compensation payment for the purchase of a set of children's clothing for attending classes for the period of study, provided for in Article 19 of this Law.

Article 22. Obligation of recipients of monthly and annual cash payments

Recipients of monthly and annual cash payments are required to notify the executive authority of the city of Moscow authorized by the Moscow Government within a month about the occurrence of circumstances affecting the right to receive them.

Article 23. Withholding of overpaid amounts

1. Excessively paid amounts of cash payments are withheld or reimbursed by the recipient if the overpayment occurred as a result of the provision of knowingly incomplete and (or) false information affecting the right and (or) amount of monetary payment, or failure to fulfill the obligation provided for in Article 22 of this Law.

2. Deductions of monthly cash payments are made in the amount of no more than 20 percent of the amount due to the recipient for each subsequent payment. If payment is terminated, the remaining debt is reimbursed by the recipient or collected from him in court.

3. Amounts of cash payments overpaid to the recipient due to the fault of the executive authority of the city of Moscow authorized by the Moscow Government are not subject to withholding, except in the case of a counting error.

Chapter 3. PROVIDING IN-KIND ASSISTANCE AND PROVIDING BENEFITS

Article 24. Categories of recipients of social support measures

Social support measures in the form of in-kind assistance and benefits are established for the following categories of recipients:

1) children of the first three years of life;

2) children under seven years of age;

3) children studying in educational institutions implementing general education programs, students of educational institutions of secondary and higher vocational education;

4) children under 15 years of age suffering chronic diseases;

5) large families;

6) families with disabled children;

6.1) pregnant women and nursing mothers;

7) mothers who gave birth and raised 10 or more children;

Article 25. Providing in-kind assistance and providing benefits to children in the first three years of life

1. Newborn children are provided with sets of baby linen.

2. For children of the first, second and third year of life, they are issued free of charge according to the conclusion of doctors. medical organizations state health care system of the city of Moscow, baby food products (including adapted milk formulas, milk, fermented milk products, cottage cheese, cereals, meat, vegetable and fruit purees, fruit and vegetable juices).

3. Children under the age of one and a half years are not included in the number of residents of residential premises when calculating fees for the removal and disposal of solid household waste.

4. Children of the first three years of life are provided free of charge medicines.

5. The procedure for providing social support measures provided for in parts 1-4 of this article is established by the Moscow Government.

Article 26. Providing benefits to children under seven years of age and families with children under seven years of age

1. Children under seven years of age are provided with the following benefits:

1) free travel in city passenger transport;

2) free visits to museums, exhibition halls, cultural and recreation parks, and the zoo, which are administered by the Moscow Government.

2. Individual categories families (student families, families of military personnel, guardians and others), provided for by the Moscow Government, enjoy benefits in paying for the maintenance of children in state preschool educational institutions.

Article 27. Providing in-kind assistance and providing benefits to children studying in educational institutions implementing general education programs, students of educational institutions of secondary and higher vocational education

1. Students in grades 1-4 of educational institutions implementing general education programs are provided with free one-time meals (breakfast).

2. Students from socially vulnerable families in educational institutions implementing general education programs are provided with free two meals a day by decision of the public commission of the educational institution.

3. Full-time students of state educational institutions of primary and secondary vocational education are provided with preferential or free hot meals in accordance with the legal acts of the city of Moscow.

4. Students in government educational institutions The “Health School” is provided with three hot meals a day in accordance with Moscow City Law No. 14 of March 10, 2004 “On general education in the city of Moscow.”

5. Students in educational institutions implementing general education programs are provided with free textbooks.

6. Full-time students in state educational institutions and non-state educational organizations with state accreditation, for primary general, basic general, secondary (full) programs general education, full-time students in state educational institutions and non-state educational organizations with state accreditation, in primary vocational education programs, full-time students in state educational institutions and non-state educational organizations with state accreditation, in secondary and higher education programs vocational education, benefits are provided for travel on all types of urban passenger transport(except for taxis and minibuses), as well as benefits for travel on suburban railway transport in the amount of 50 percent in the period from September 1 to June 15 in the manner established by the Moscow Government.

7. Full-time students in state educational institutions and non-state educational organizations that have state accreditation, in programs of primary general, basic general, secondary (complete) general education, full-time students in state educational institutions and non-state educational organizations that have state accreditation, for programs of primary vocational education, students studying full-time in state educational institutions and non-state educational organizations with state accreditation, for programs of secondary and higher vocational education, have the right to free visits to the zoo, payment at preferential prices established by the Moscow Government, visits to museums, cultural and recreational parks, exhibitions and cultural and educational events in the specified cultural institutions under the jurisdiction of the Moscow Government.

Article 28. Providing in-kind assistance to children under 15 years of age suffering from chronic diseases

Children under the age of 15 who suffer from chronic diseases, the list of which is approved by the Moscow Government, are provided with free food, based on the conclusion of doctors from medical organizations of the Moscow state health care system.

Article 29. Providing in-kind assistance and providing benefits to large families

1. Large families, depending on the category of children, are provided with in-kind assistance and benefits:

1) free supply of baby food, based on the opinion of doctors of medical organizations of the state health care system of the city of Moscow, in the manner established by the Moscow Government - for children under seven years of age;

2) free software medicines for children under 18 years of age;

3) free two meals a day for children studying in educational institutions implementing general education programs;

4) free travel on all types of urban passenger transport (except taxis and minibuses) for children under 16 years of age (students in educational institutions - up to 18 years of age);

5) for the admission of children to state preschool educational institutions of the city of Moscow in the first place;

6) free travel on suburban railway transport for children under the age of 16 (students in educational institutions implementing general education programs - up to 18 years);

7) free use children with paid physical education, health and sports services provided by institutions included in the city state system physical culture and sports, in the manner established by the Moscow Government.

2. Large families are provided with in-kind assistance and the following benefits:

1) exemption from paying for the maintenance of children in state preschool educational institutions;

2) to establish the amount of payment for residential premises and utilities in the manner and on the terms established by the Moscow Government;

3) the right to provide residential premises owned by the city of Moscow and subsidies for the acquisition or construction of residential premises in the manner and under the conditions established by federal legislation and legal acts of the city of Moscow;

4) the right to free visits to the zoo, payment at preferential prices established by the Moscow Government, visits to museums, cultural and recreation parks, exhibitions, stadiums, cultural, educational and sporting events in the specified cultural and sports institutions administered by the Moscow Government, and one once a month - free visits to museums and stadiums;

5) preemptive right to receive garden plots;

6) the right to free use of the services of baths run by the Moscow Government;

7) the right to free travel on all types of urban passenger transport (except taxis and minibuses) to one of the parents in a large family.

Article 30. Providing in-kind assistance and providing benefits to families with disabled children and disabled children or disabled children from childhood up to the age of 23

1. Families with disabled children are provided with the following benefits:

1) the right to provide residential premises owned by the city of Moscow and subsidies for the acquisition or construction of residential premises in the manner and under the conditions established by federal legislation and legal acts of the city of Moscow;

2) to establish the amount of payment for residential premises and utilities in the manner and on the terms established by the Moscow Government.

2. Parents are exempt from paying for the maintenance of disabled children in state preschool educational institutions.

3. Disabled children, their parents (guardians, trustees), persons accompanying a disabled child, as well as one of the parents of a disabled person from childhood under the age of 23 studying in an educational institution, have the right to free travel on all types of city passenger transport (except taxis and minibuses).

4. Based on the conclusion of doctors from medical organizations of the Moscow state health care system, children with disabilities are provided with free baby food products in the manner established by the Moscow Government.

5. Disabled children are provided with products medical purposes and medicines, with the exception of those provided for by federal legislation social services regarding the provision of medicines.

6. Disabled children have the right to free visits to museums, exhibition halls, cultural and recreation parks, and the zoo, which are administered by the Moscow Government.

7. Disabled children and people with disabilities from childhood up to the age of 23 are given the right to free use of paid physical education and sports services provided by institutions that are part of the city state system of physical culture and sports, in the manner established by the Moscow Government.

Article 30.1. Providing natural assistance to pregnant women and nursing mothers

Pregnant women and nursing mothers are provided with free food, based on the conclusion of doctors from medical organizations of the Moscow state health care system, in the manner established by the Moscow Government.

Article 31. Providing benefits to mothers of many children who gave birth and raised five or more children

1. Mothers who have given birth and raised five or more children are provided with free production and repair of dentures (except for dentures made of precious metals, porcelain, metal-ceramics) in medical organizations of the state health care system of the city of Moscow.

2. Mothers who have given birth and raised 10 or more children are provided with the benefit specified in Part 1 of this article, as well as free provision of medications for outpatient treatment according to prescriptions from doctors of medical organizations of the Moscow state health care system.

Article 32. Providing in-kind assistance and providing benefits to other categories of families with children

1. Certain categories of families with children have the right to the provision of residential premises owned by the city of Moscow and subsidies for the acquisition or construction of residential premises in the manner and under the conditions established by federal legislation and legal acts of the city of Moscow.

2. Children aged seven to 18 years have the right to free visits to the zoo, payment at preferential prices established by the Moscow Government, visits to museums, cultural and recreation parks, exhibitions and cultural and educational events in the specified cultural institutions, and once a month - free visits to museums.

3. The procedure and conditions for carrying out health-improving measures for children during the summer and winter holidays are established by the Moscow Government.

4. The guardian (trustee) of an orphan or a child left without parental care under the age of 18 has the right to free travel on all types of city passenger transport (except for taxis and minibuses).

5. The adoptive parent of a child under the age of 18 has the right to free travel on all types of city passenger transport (except taxis and minibuses).

6. A foster carer for a child under the age of 18 has the right to free travel on all types of city passenger transport (except taxis and minibuses).

7. Categories of citizens and children who have the right to use paid physical education, health and sports services provided by institutions included in the city state system of physical culture and sports, on preferential terms, are determined by the legislation of the city of Moscow on physical culture and sports.

Chapter 4. SOCIAL SERVICE ORGANIZATION

Article 33. Provision of social services

The provision of social services to children and families with children is carried out in accordance with the Moscow City Law of July 9, 2008 N 34 “On social services population and social assistance in the city of Moscow."

Chapter 5. FINAL PROVISIONS

Article 36. Dispute resolution procedure

Refusal to provide social support measures may be appealed to the appropriate higher authority and/or to court.

Article 37. Financing of social support measures

Financing of social support measures provided for by this Law is an expenditure obligation of the city of Moscow.

Article 38. Entry into force of this Law

1. This Law comes into force on January 1, 2006, with the exception of Article 9 of this Law.

2. Article 9 of this Law comes into force on January 1, 2006 in relation to persons caring for a disabled child under the age of three, and from January 1, 2007 - in relation to persons caring for a disabled child under the age of 18 years old or disabled since childhood under the age of 23 years.

3. Legal acts the cities of Moscow, adopted before the entry into force of this Law, providing for the provision of social support to families with children, are applied to the extent that does not contradict this Law.

4. Persons to whom monetary payments were established before January 1, 2006 retain the right to receive them in accordance with the laws of the city of Moscow and other legal acts of the city of Moscow that were in force before the adoption of this Law.

5. Legal acts of the Moscow Mayor and the Moscow Government must be brought into compliance with this Law within six months from the date of its entry into force.
