“In accordance with the “Regulations on the Federal Service for Labor and Employment”, the Federal Service for Labor and Employment is a federal executive body exercising control and supervision functions in the field of labor, employment and alternative civil service, providing public services in the field of promoting employment and protecting against unemployment, labor migration and settlement of collective labor disputes.

Functions of the Federal Service for Labor and Employment:

1. Implementation of state supervision and control over the implementation of labor legislation by employers;

2. Assessment of the state and forecast of development of employment of the population, informing about the situation in the labor market;

3. Development and implementation of federal, territorial (territorial, regional, district, city) and other targeted programs to promote employment of citizens at risk of dismissal, as well as citizens in particular need of social protection and experiencing difficulties in finding work;

4. Assisting citizens in finding suitable work, and employers in finding the necessary workers;

5. Organization of active employment policy events, if necessary, professional guidance, vocational training, retraining and advanced training of unemployed citizens;

6. Implementation social payments in the form of unemployment benefits, scholarships during the training period in the direction of the employment service, provision of material and other assistance to unemployed citizens and family members of the unemployed who are supported by them.

Services related to promoting the employment of citizens are provided by employment services free of charge.”

The Federal Service for Labor and Employment is vested with the following powers:

Implements state supervision and monitoring compliance by employers with labor legislation, the established procedure for investigating and recording industrial accidents;

Supervises the legal regulation carried out by the authorities state power constituent entities of the Russian Federation on issues of delegated powers in the field of promoting employment;

Exercises control over the passage by citizens of alternative civil service and dismissal from it, the expenditure by executive authorities of the constituent entities of the Russian Federation of funds provided in the form of subventions from the federal budget for the implementation of delegated powers, within its competence;

Registers in notification procedure industry (inter-industry) agreements concluded at the federal level of social partnership;

Registers, in a notification procedure, collective labor disputes regarding the conclusion, amendment and implementation of agreements concluded at the federal level of social partnership, collective labor disputes in organizations financed from the federal budget, as well as collective labor disputes arising in cases where, in accordance with the legislation of the Russian Federation, Federation, in order to resolve a collective labor dispute, a strike cannot be carried out;

Maintains databases for registering labor arbitrators;

Informs about the situation on the labor market in the Russian Federation, rights and guarantees in the field of employment and protection against unemployment;

Carries out state examination of working conditions;

Forms and maintains registers of recipients of public services in the field of employment;

Analyzes the circumstances and causes of identified violations of labor legislation and other regulatory legal acts containing labor law norms, takes measures to eliminate them and restore the violated labor rights of citizens;

Participates in the preparation of proposals regarding the need to attract foreign workers and the formation of quotas for the implementation foreign citizens labor activity In Russian federation;

I. General provisions

1. The Federal Service for Labor and Employment (Rostrud) is a federal executive body exercising control and supervision functions in the field of labor, employment, alternative civil service, special assessment of working conditions and social protection of the population, provision of public services in the field of promoting employment. and protection from unemployment, labor migration and the settlement of collective labor disputes, as well as the provision of social guarantees established by the legislation of the Russian Federation for socially vulnerable categories of citizens.

3. The Federal Service for Labor and Employment is guided in its activities by the Constitution of the Russian Federation, federal constitutional laws, federal laws, acts of the President of the Russian Federation and the Government of the Russian Federation, international treaties Russian Federation, regulatory legal acts Ministry of Labor and Social Protection of the Russian Federation, as well as these Regulations.

4. The Federal Service for Labor and Employment carries out its activities directly and through its territorial bodies in interaction with other federal executive authorities, executive authorities of the constituent entities of the Russian Federation, bodies local government, public associations and other organizations.

II. Authority

5. The Federal Service for Labor and Employment exercises the following powers:

5.1. carries out state supervision and control over compliance with:

5.1.1. employers of labor legislation and other regulatory legal acts containing labor law norms, through inspections, surveys, issuing binding orders to eliminate violations, drawing up protocols on administrative offenses within the scope of authority, preparing other materials (documents) on bringing the perpetrators to justice in accordance with federal laws and other regulatory legal acts of the Russian Federation;

5.10.1. organizes and conducts civil defense in the Service;

5.11. organizes additional professional education employees of the central office of the Service, territorial bodies;

5.12. carries out, in accordance with the legislation of the Russian Federation, work on acquisition, storage, accounting and use archival documents, formed in the course of the activities of the Service;

5.13. interacts in the prescribed manner with government authorities of foreign states and international organizations in the established field of activity;

5.14. carries out in accordance with the legislation of the Russian Federation and other regulatory legal acts on contract system in the field of procurement of goods, works, services to provide government and municipal needs procurement of goods, works, services in the established field of activity;

5.15. performs other functions in the established field of activity, if such functions are provided for by federal laws, regulatory legal acts of the President of the Russian Federation or the Government of the Russian Federation.

6. In order to exercise powers in the established field of activity, the Federal Service for Labor and Employment has the right:

6.1. organize the necessary surveys, tests, examinations, analyzes and assessments, as well as scientific research on issues of supervision and control, provision of public services in the established field of activity;

6.2. provide legal entities and individuals with explanations on issues within the competence of the Service;

6.3. request and receive information necessary to make decisions on issues within the competence of the Service;

6.4. involve, in the prescribed manner, scientific and other organizations, scientists and specialists to study issues within the established scope of activity;

6.5. apply restrictive, precautionary and prophylactic measures provided for by the legislation of the Russian Federation, aimed at preventing and (or) eliminating the consequences of violations by legal entities and citizens mandatory requirements in the established field of activity;

6.5(1). draw up protocols on administrative offenses in cases provided for by the legislation of the Russian Federation on administrative offenses;

7. The Federal Service for Labor and Employment does not have the right to carry out legal regulation in the established field of activity, except in cases established by decrees of the President of the Russian Federation and decrees of the Government of the Russian Federation, as well as management of state property and the provision of paid services.

The restrictions on the powers of the Service established by paragraph one of this clause do not apply to the powers of the head of the Federal Service for Labor and Employment to manage property assigned to the Service by right operational management, resolving personnel issues and issues of organizing the activities of the Service, monitoring activities in the Service headed by him (its structural divisions, territorial authorities).

III. Organization of activities

8. The Federal Service for Labor and Employment is headed by a director appointed and dismissed by the Government of the Russian Federation on the proposal of the Minister of Labor and Social Protection of the Russian Federation.

The head of the Federal Service for Labor and Employment is the chief state labor inspector of the Russian Federation.

The head of the Federal Service for Labor and Employment is personally responsible for the implementation of the functions assigned to the Service.

The head of the Federal Service for Labor and Employment has deputies who are appointed and dismissed by the Government of the Russian Federation on the proposal of the Minister of Labor and Social Protection of the Russian Federation.

9.2.5. draft regulations on the territorial bodies of the Service;

9.2.6. draft annual plan and forecast indicators of the Service, as well as a report on their implementation;

9.2.7. proposals for the formation of the draft federal budget in terms of financial security activities of the Service;

9.2.8. proposals for presentation of state awards of the Russian Federation, Certificate of Honor of the President of the Russian Federation, Certificate of Honor of the Government of the Russian Federation, for encouragement in the form of an announcement of gratitude from the President of the Russian Federation, an announcement of gratitude from the Government of the Russian Federation, for awarding a departmental insignia of the Ministry of Labor and Social Protection of the Russian Federation , giving the right to confer the title “Veteran of Labor” to employees of the central office of the Service and its territorial bodies, as well as other persons carrying out activities in the established field;

9.3. appoints and dismisses employees of the central apparatus of the Service and deputy heads of its territorial bodies;

9.4. resolves, in accordance with the legislation of the Russian Federation on civil service, issues related to the passage of the federal civil service in the Federal Service for Labor and Employment;

9.5. approves the structure and staffing table of the Service within the limits of the wage fund and number of employees established by the Government of the Russian Federation, the cost estimate for its maintenance within the limits of the appropriations approved for the corresponding period, provided for in federal budget;

9.6. approves the number and wage fund of employees of the territorial bodies of the Service within the limits established by the Government of the Russian Federation, as well as the estimated costs for their maintenance within the limits of the appropriations approved for the corresponding period provided for in the federal budget;

The Federal Service for Labor and Employment has the right to have a heraldic sign - an emblem, a flag and a pennant, established by the Ministry of Labor and Social Protection of the Russian Federation in agreement with the Heraldic Council under the President of the Russian Federation.

12. The location of the Federal Service for Labor and Employment is Moscow.
